Fire risk assessments and your legal responsibilities

In England and Wales, the Regulatory Reform (Fire Safety) Order 2005, as amended, places duties on the responsible person for premises within its scope. A suitable and sufficient assessment must identify the precautions needed to protect relevant persons. The assessment must be reviewed regularly and when changes or other circumstances mean it may no longer be valid.

Scotland has a separate framework under Part 3 of the Fire (Scotland) Act 2005 and the Fire Safety (Scotland) Regulations 2006. Northern Ireland has separate requirements under the Fire and Rescue Services (Northern Ireland) Order 2006 and the Fire Safety Regulations (Northern Ireland) 2010.

The requirements depend on where the property is located and how it is used. We explain which requirements apply and agree what the assessment will cover. The person responsible for fire safety retains their legal duties when appointing an assessor.
